Please read these Terms of Use carefully before using our website or making a reservation. By using our Site or Services, you agree to be bound by these Terms.
1. Agreement to Terms
These Website Terms of Use (“Terms”) constitute a legally binding agreement between you and Bean There LLC d/b/a Mighty Mini Equipment Rental (“Mighty Mini,” “Company,” “we,” “us,” or “our”) governing your access to and use of our website and online booking portal.
By accessing our Site, completing a reservation, or clicking “I Agree” at any booking confirmation step, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Site or Services.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” and “your” will refer to that entity.
Electronic acceptance of these Terms — including clicking a checkbox or completing a booking — is legally binding to the same extent as a handwritten signature.
2. Definitions
For purposes of these Terms:
- “Agreement” means these Terms of Use, together with our Privacy Policy, Rental Policies, and any Rental Agreement you enter into with us, all of which are incorporated by reference.
- “Site” means our website and all pages, content, and features accessible through it.
- “Services” means our website, our online booking portal, our equipment rental services, any mobile applications we offer, and any other products or services we make available through our business.
- “Rental Period” means the period beginning when equipment is transferred to you and ending when it is returned to us in accordance with your Rental Agreement.
- “Rental Agreement” means the Equipment Rental Agreement governing the actual rental transaction, which is separate from these Terms.
- “Rental Policies” means our Booking and Rental Policies document, available at mightyminirental.com/rental-policies/, which governs deposits, cancellations, security deposits, and related booking terms.
3. Eligibility
To use the Site or Services, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Services under any applicable law
By using the Site or Services, you represent and warrant that you meet all of the above requirements. If you do not meet these requirements, you must not access or use the Site or Services.
4. Scope of These Terms
These Terms govern your use of the Site and Services — including browsing our website, making reservations through our online booking portal, and any future mobile application we offer.
These Terms do not govern the rental transaction itself. Once you take possession of equipment, your rights and obligations are governed by the Rental Agreement you sign at or before pickup. In the event of any conflict between these Terms and the Rental Agreement with respect to the rental transaction, the Rental Agreement governs.
Together, these Terms, the Privacy Policy, the Rental Policies, and the Rental Agreement constitute the complete agreement between you and Mighty Mini with respect to your use of our Services and your rental of equipment from us.
5. Reservations, Deposits, and Payments
5.1 Rental Policies
Our booking deposit, cancellation policy, security deposit structure, and extension and early return terms are governed by our Rental Policies, available at mightyminirental.com/rental-policies/. The Rental Policies are incorporated into this Agreement by reference and form part of the complete agreement between you and Mighty Mini. By completing a reservation, you confirm that you have read and agree to the Rental Policies in effect at the time of your booking.
5.2 Payment Authorization
By completing a reservation or rental, you authorize Mighty Mini to charge your payment method on file for all amounts due, including rental fees, deposits, cancellation charges, damage assessments, cleaning fees, fuel and DEF charges, and any other charges incurred under these Terms, the Rental Policies, or your Rental Agreement. Payment processing is handled by our third-party payment processor. Mighty Mini does not store your full card number, CVV, or expiration date.
Fund capture timing: Rental charges and any amounts due are captured at the end of the Rental Period upon return of the equipment. If equipment is not returned by the end of the Rental Period, rental charges continue to accrue at the applicable daily rate. If equipment remains unreturned 48 hours after the scheduled return time, Mighty Mini will capture all accrued charges, initiate contact with law enforcement, and take all other remedies available under the Rental Agreement. The 48-hour window is not a grace period; charges accrue continuously from the moment the Rental Period expires.
6. Acceptable Use
You agree to use the Site and Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Site if you are under 18 years of age
- Provide false, inaccurate, or misleading information at any point during the reservation or rental process
- Access or attempt to access any account, booking, or data that does not belong to you
- Use automated tools, bots, scrapers, or similar technology to access or collect data from the Site without our prior written consent
- Attempt to interfere with, disrupt, or compromise the security or functionality of the Site or any connected systems
- Use the Site or Services for any unlawful purpose or in violation of any applicable law or regulation
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload, transmit, or introduce any malicious code, virus, or harmful content to the Site
- Copy, scrape, or redistribute Site content without prior written authorization
7. Intellectual Property
All content on the Site — including text, images, photographs, graphics, logos, icons, audio, video, and software — is owned by Mighty Mini or licensed to Mighty Mini and is protected by applicable copyright, trademark, and other intellectual property laws.
You may view and use Site content for personal, non-commercial purposes related to evaluating or using our Services. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any Site content without our prior written consent.
The Mighty Mini name, logo, and marks are proprietary to Bean There LLC. Unauthorized use of our name, logo, or marks is prohibited.
User-submitted content: If you submit any content to us — including inquiries, reviews, or feedback — you grant Mighty Mini a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with operating and promoting our Services. You represent that you own or have the right to submit any content you provide.
8. Third-Party Services and Links
Our Site and booking portal may contain links to or integrations with third-party websites and services, including our booking platform and payment processor. These third-party services are governed by their own terms and privacy policies. Mighty Mini is not responsible for the content, practices, or availability of third-party sites. A link to or integration with a third-party service does not constitute an endorsement.
We encourage you to review the terms and privacy policies of any third-party service you use in connection with our Services.
9. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not warrant that the Site will be available without interruption, error-free, or free from viruses or other harmful components. We do not warrant the accuracy or completeness of any content on the Site.
Mighty Mini does not manufacture the equipment available for rent and makes no warranties regarding equipment through the Site. Equipment warranties, to the extent any exist, are governed solely by the Rental Agreement and applicable law.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIGHTY MINI AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the extent Mighty Mini is found liable for any claim arising from your use of the Site, our total liability will not exceed the lesser of: (a) the total amounts you paid to Mighty Mini in the six months preceding the claim; or (b) one hundred dollars ($100).
Some jurisdictions do not permit the exclusion or limitation of certain damages. If you are located in such a jurisdiction, some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Mighty Mini and its members, managers, officers, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney fees) arising out of or related to:
- Your use of or access to the Site or Services
- Your breach of any provision of these Terms
- Your violation of any applicable law or regulation
- Your violation of any third-party right, including intellectual property or privacy rights
- Any content you submit through the Site
12. SMS Communications
If you provide a mobile phone number and consent to receive text messages from Mighty Mini, you may receive automated messages including rental confirmations, return reminders, and account updates. Message and data rates may apply. Message frequency varies.
To opt out at any time, reply STOP to any message. For help, reply HELP or contact us at contact@mightyminirental.com. Consent to receive SMS communications is not required as a condition of making a reservation or renting equipment.
13. Privacy
Your use of the Site and Services is subject to our Privacy Policy, available at mightyminirental.com/privacy-policy/. The Privacy Policy is incorporated into these Terms by reference. By using the Site or Services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
14. Dispute Resolution
14.1 Good Faith Negotiation
Before filing any legal claim against Mighty Mini, you agree to contact us at contact@mightyminirental.com and attempt in good faith to resolve the dispute directly. We will make reasonable efforts to respond and resolve your concern within 30 days. If the dispute remains unresolved after 30 days of good-faith negotiation, either party may pursue the available legal remedies described below.
14.2 Governing Law
These Terms and any dispute arising out of or related to your use of the Site or Services are governed by the laws of the State of Wisconsin, without regard to conflict of law principles. This choice of law applies regardless of where you are located.
If you are located outside Wisconsin, please note that Wisconsin law may differ from the law of your home state. To the extent applicable mandatory consumer protection laws of your home state provide you with rights that cannot be waived by contract, those rights are not affected by this choice of law provision.
14.3 Venue
Any legal proceeding arising out of or related to these Terms that is not resolved through negotiation will be brought exclusively in the state courts of Iowa County, Wisconsin. You consent to personal jurisdiction in Iowa County, Wisconsin for this purpose.
14.4 Small Claims
Nothing in these Terms prevents either party from bringing an eligible claim in Iowa County small claims court.
14.5 No Arbitration
Mighty Mini does not require arbitration at this time. You retain the right to bring claims in court as described above. Mighty Mini reserves the right to introduce arbitration by future amendment to these Terms, with notice provided in accordance with Section 15.
15. Changes to These Terms
We may update these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify you by email or through a notice on the Site. Your continued use of the Site or Services after any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site and Services.
16. Termination
Mighty Mini reserves the right to suspend or terminate your access to the Site or Services at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Termination of your access to the Site does not release you from any obligations already incurred under a Rental Agreement or any other agreement with Mighty Mini. Sections 7, 9, 10, 11, and 14 of these Terms survive termination.
17. General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, the Rental Policies, and any Rental Agreement you enter into with Mighty Mini, constitute the complete agreement between you and Mighty Mini with respect to the subject matter herein and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
No Waiver. Mighty Mini’s failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Mighty Mini may assign these Terms without restriction.
Independent Contractors. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Mighty Mini.
No Third-Party Beneficiaries. These Terms do not create rights in any third party.
