Mighty Mini Equipment Rental

These Rental Policies describe the booking, deposit, cancellation, and rental management practices of Bean There LLC d/b/a Mighty Mini Equipment Rental (“Mighty Mini Equipment Rental,” “we,” “us,” or “our”). These Policies are incorporated by reference into our Website Terms of Use and Equipment Rental Agreement. Together, these documents constitute the complete agreement between you and Mighty Mini Equipment Rental with respect to your reservation and rental of equipment.

1. Booking Deposit
Reservations completed through our online booking portal require payment by credit or debit card. Cash and check are not accepted for online reservations. All charges associated with an online reservation, including the booking deposit, rental fees, and any applicable damage waiver fee, are processed through our third-party payment processor.
A non-refundable deposit of 10% of the total booking cost is required to hold a reservation. The deposit is applied toward the total rental cost at the time of your rental. By completing a booking, you authorize Mighty Mini Equipment Rental to charge this deposit to your payment method.
Deposit credit on rescheduling: If you cancel a booking and rebook within 3 months of the original cancellation date, the deposit from the original booking will be applied to the new booking. No refund or forward credit is available after 3 months from the original cancellation date.
2. Cancellation Policy
If you cancel a booking within 24 hours of the scheduled rental start time, you will be charged a cancellation fee equal to one day’s rental rate for the equipment reserved. Cancellation charges are capped at one day’s rental rate regardless of the length of the original booking.
Cancellation credit on rebooking: If you cancel within 24 hours of the rental start time and rebook within 3 months, the one-day cancellation charge will be credited toward your next rental.
Deposit and cancellation interaction: If your 10% booking deposit exceeds the one-day cancellation charge, Mighty Mini Equipment Rental will refund the difference so that Mighty Mini Equipment Rental retains exactly the one-day rental rate. No additional cancellation charge beyond the one-day rate will be assessed.
3. Eligibility and Pre-Possession Requirements
Eligibility
To rent equipment from Mighty Mini Equipment Rental, you must:
- Be at least 18 years of age
- Be a resident of the United States
- Have the legal capacity to enter into binding contracts
- Present a valid government-issued photo ID at pickup
Mighty Mini Equipment Rental will verify your identity at pickup. A copy of your government-issued ID will be retained in accordance with our Privacy Policy. If you do not meet these eligibility requirements or cannot present valid ID, equipment will not be released.
Pre-Possession Requirements
Before taking possession of any equipment, the renter must complete the following at or before pickup:
- Rental Agreement — a signed Equipment Rental Agreement specific to the rented equipment
- Safety Acknowledgment — an equipment-specific safety acknowledgment form confirming the renter understands the hazards, operation requirements, and applicable safety obligations for the equipment being rented
- Damage Waiver Election — the renter must elect or decline the optional Damage Waiver described in Section 5. The Damage Waiver is always optional regardless of whether a Certificate of Insurance is provided.
Completion of all required documents is a condition of taking possession of equipment. Equipment will not be released until all required documents are executed.
Right to Refuse: Mighty Mini Equipment Rental reserves the right to refuse rental to any person we determine is incapable of safely or properly operating the requested equipment, regardless of whether a reservation has been made or a booking deposit has been paid. In the event of refusal, Mighty Mini Equipment Rental will refund any booking deposit collected.
4. Security Deposits, Payment Authorization, and Return Requirements
Replacement Value
The term “replacement value” as used in these Policies means the fair market value of the equipment at the time of rental, as set by Mighty Mini Equipment Rental and documented in the equipment listing on our website and on the front page of your Rental Agreement. Replacement value is disclosed before you complete your rental and is the basis for calculating your security deposit hold, damage waiver fee, and damage waiver coverage cap.
Mighty Mini Equipment Rental will authorize a hold on your payment method at the time of pickup. The hold is not a charge; funds are captured only as needed to cover amounts due under the Rental Agreement.
Standard Hold (No COI): The hold will equal the greater of: (i) the FMV-based deposit amount; or (ii) the rental fees calculation.
The FMV-based deposit is calculated on a tiered basis:
- For equipment with a replacement value up to $1,000: 50% of the replacement value (maximum $500).
- For equipment with a replacement value between $1,001 and $15,000: $500 plus 20% of the amount by which the replacement value exceeds $1,000 (maximum $3,300 at $15,000 replacement value).
- Equipment with a replacement value exceeding $15,000 may not be rented without a valid Certificate of Insurance. The COI requirement for high-value equipment applies regardless of whether the Damage Waiver is elected.
The rental fees calculation is:
- Where rental charges are assessed on a daily basis: the expected rental fees for the reserved period, plus two additional days at the applicable daily rate.
- Where rental charges are assessed on a weekly basis: the applicable weekly rate, plus two additional days at the applicable daily rate.
Reduced Hold (Valid COI Provided): Renters who provide a current Certificate of Insurance naming Mighty Mini Equipment Rental as additional insured and loss payee will have their hold reduced to the rental fees calculation: the expected rental fees for the reserved period plus two additional days at the applicable daily rate (or the applicable weekly rate plus two additional days at the daily rate where a weekly rental rate applies). The COI must be presented at or before pickup with coverage limits acceptable to Mighty Mini Equipment Rental.
Adjustment and Capture: Rental charges and any applicable fees are adjusted and captured at the time of equipment return. Any hold not applied to charges will be released within two (2) business days of return.
Rentals Exceeding 7 Days: For rental periods exceeding 7 days, Mighty Mini Equipment Rental reserves the right to re-authorize the hold before the original authorization expires and to process partial captures of accrued rental charges at 7-day intervals during the rental period. Renters will be informed of this practice at pickup.
Failure to Return — 48-Hour Rule: If equipment is not returned by the end of the Rental Period, rental charges will continue to accrue at the standard daily rate. Where circumstances indicate suspected theft by conversion, Mighty Mini Equipment Rental will capture all accrued charges and the full hold within 48 hours of the scheduled return time and will contact law enforcement. Where equipment is overdue without indication of theft, Mighty Mini Equipment Rental will attempt to contact the renter before initiating escalation procedures.
Early Repossession — Suspected Theft During Rental Period: Where circumstances during an active Rental Period suggest that equipment has been stolen, abandoned, or is at risk of loss, Mighty Mini Equipment Rental reserves the right to initiate repossession of the equipment before the scheduled end of the Rental Period. Mighty Mini Equipment Rental will attempt to contact the renter before taking repossession action. Contact may be made by phone, email, or text message. If the renter cannot be reached or if circumstances require immediate action to prevent loss, Mighty Mini Equipment Rental may proceed with repossession and law enforcement notification without further delay. Rental charges will be captured through the date of repossession or the date the equipment is recovered, whichever is later.
Equipment Delivery: Delivery of equipment is negotiated separately from rental costs. Delivery fees, terms, and availability are confirmed at the time of booking and are not included in the rental rate displayed on equipment listings.
Equipment Return
Mighty Mini Equipment Rental operates on a delivery and pickup basis. For standard rentals, equipment is retrieved by Mighty Mini Equipment Rental from the rental location at the end of the Rental Period. Renters must ensure equipment is accessible, in its agreed location, and available for pickup at the scheduled return time. If a customer-return arrangement has been specifically agreed to in writing, the renter must return equipment to the address confirmed by Mighty Mini Equipment Rental in writing, during regular business hours.
Equipment Return Conditions
Equipment must be returned in the same condition as it was in when transferred to the renter, subject only to reasonable wear and tear. The following return requirements apply to all rentals:
- Fuel: Equipment must be returned with fuel at the same level as at the start of the Rental Period. Equipment returned with insufficient fuel will be subject to a fuel replacement charge plus an administrative fee.
- Diesel Exhaust Fluid (DEF): Where applicable, DEF must be returned to the level present at the start of the Rental Period. Equipment returned with insufficient DEF will be subject to a DEF replacement charge plus an administrative fee.
- Attachments and accessories: All attachments, accessories, and components present at pickup must be returned with the equipment.
- Cleanliness: Equipment must be returned in a reasonably clean condition. Equipment requiring cleaning beyond normal use will be subject to a cleaning charge.
Failure to meet return requirements will result in applicable charges captured from the security deposit hold or charged to the renter’s payment method.
Renter Obligation to Report Damage and Incidents
Renters must immediately notify Mighty Mini Equipment Rental in the event of any accident, damage event, equipment malfunction, or incident involving the equipment during the Rental Period. Notification must be made by phone at (414) 436-9158 or by email at contact@mightyminirental.com. Renters must preserve the scene where safe to do so, photograph damage, and cooperate fully with any subsequent investigation.
Failure to report damage or incidents promptly may affect the applicability of the Damage Waiver, may constitute a violation of the Rental Agreement, and does not reduce the renter’s financial liability for damage.
Right to Seek Additional Damages
Mighty Mini Equipment Rental reserves the right to seek additional compensation from the renter for any losses, costs, or damages not fully covered by the security deposit hold, the renter’s Certificate of Insurance, the Damage Waiver, or any combination thereof. This includes but is not limited to repair or replacement costs exceeding the deposit hold, loss of use charges during the period equipment is unavailable due to damage or loss, and costs of collection including reasonable attorney fees. Pursuit of additional damages may include charges to the renter’s payment method, referral to a collection agency, or civil proceedings.
5. Damage Waiver
What the Damage Waiver Is
Mighty Mini Equipment Rental offers an optional Damage Waiver for each rental. The Damage Waiver is not insurance and does not constitute a guarantee against all loss. Mighty Mini Equipment Rental may profit from the Damage Waiver fee.
Scope
The Damage Waiver applies only to damage incurred during the specific Rental Period for which it was purchased. Each rental transaction requires its own Damage Waiver election. A Damage Waiver purchased for one rental does not extend to any prior or future rental period. The Damage Waiver election must be made at or before pickup and cannot be added after equipment has been transferred to the renter.
Damage Assessment
Where damage is assessed, Mighty Mini Equipment Rental will determine the charge using one of the following methods:
- Cost to repair: the actual cost to restore the equipment to its pre-damage condition, including parts and labor at fair market rates. Where third-party repair services are used, actual invoiced costs will be passed to the renter. Where repairs are performed internally by Mighty Mini Equipment Rental staff, labor will be charged at fair market rates for the services performed.
- Reduction in fair market value: the difference between the equipment’s fair market value immediately before and after the damage event, where repair is not practical or cost-effective.
Mighty Mini Equipment Rental will not profit from damage charges beyond actual costs. Where third-party repair quotes are obtained, documentation will be provided to the renter. For standard damage, assessment will be completed within two (2) business days of equipment return. For significant or complex damage requiring external evaluation or third-party quotes, assessment may take up to fourteen (14) calendar days from the date of return. In such cases, the full deposit hold will be captured immediately upon identifying the damage event and funds will be applied to confirmed charges or refunded upon completion of assessment.
Fee
The Damage Waiver fee is 10% of the equipment’s replacement value, charged once per rental period regardless of rental duration.
Coverage
If elected, the Damage Waiver limits the renter’s direct financial responsibility for accidental damage to the equipment. Mighty Mini Equipment Rental will absorb repair or replacement costs up to 75% of the equipment’s replacement value per incident. The renter remains responsible for any damage costs exceeding 75% of replacement value per incident.
Example: Equipment with a replacement value of $800 has a Damage Waiver fee of $80 and per-incident coverage of up to $600. If accidental damage results in $350 in repair costs, the renter owes nothing beyond the waiver fee. If damage results in $600 in repair costs, the renter is responsible for $0 — the full $600 falls within 75% of $800.
Underinsurance
Any damage costs not absorbed by the Damage Waiver, not covered by the renter’s Certificate of Insurance, or not covered by any combination of the two remain the renter’s direct financial responsibility. This includes but is not limited to: damage costs exceeding the Damage Waiver coverage cap; damage claims denied or only partially paid by the renter’s insurer due to policy limits, deductibles, exclusions, or lapsed coverage; and damage costs that fall outside the scope of both the Damage Waiver and the renter’s insurance. Mighty Mini Equipment Rental will pursue uncovered amounts as additional charges against the renter’s payment method or through other available remedies including collections and civil proceedings.
Damage Waiver Exclusions
The Damage Waiver does not apply to, and the renter remains fully liable for:
- Theft, vandalism, mysterious disappearance, or wrongful conversion of equipment
- Loss or damage to accessory equipment, attachments, or consumables
- Damage resulting from misuse, abuse, overloading, exceeding rated capacity, or operation by an unqualified operator
- Damage resulting from failure to maintain fuel or DEF levels, use of incorrect fuel type, or use of contaminated or poor-quality fuel
- Damage resulting from failure to monitor the key maintenance items and operational indicators identified on the equipment-specific maintenance checklist provided at pickup, or from continued operation of equipment after any monitored item or indicator has fallen outside normal operating parameters without ceasing operation and notifying Mighty Mini Equipment Rental
- Tire, tube, rubber track, and hose damage caused by blowouts, cuts, bruises, punctures, or other causes inherent in use
- Damage caused by a third party not associated with the renter
- Damage caused by violation of the Rental Agreement or these Policies
- Damage caused by negligence or willful misconduct
Certificate of Insurance and Security Deposit
Providing a valid Certificate of Insurance naming Mighty Mini Equipment Rental as additional insured and loss payee reduces the security deposit hold to rental fees plus two additional days, as described in Section 4. The COI must cover damage to equipment in the renter’s care, custody, and control with coverage limits acceptable to Mighty Mini Equipment Rental.
Providing a COI does not remove the option to elect the Damage Waiver, nor does it require the renter to elect it. The Damage Waiver remains optional regardless of whether a COI is provided. Providing a COI applies to all rentals going forward and may not be applied retroactively to completed rentals.
The renter is responsible for ensuring their insurance provides adequate coverage for the equipment rented. Where a COI is provided and a damage claim arises, any amounts not paid by the renter’s insurer — including amounts below the policy deductible, amounts above policy limits, or amounts excluded under the renter’s policy — remain the renter’s direct financial responsibility regardless of whether a Damage Waiver was also elected.
6. Extensions and Early Returns
Extensions: If you wish to extend your Rental Period, you must contact Mighty Mini Equipment Rental before the end of your scheduled rental term. Extensions are subject to equipment availability and are not guaranteed. Mighty Mini Equipment Rental is under no obligation to grant an extension.
Early returns: If you return equipment before the end of your scheduled Rental Period, you will be charged for the actual number of days the equipment was in your possession, rounded up to the nearest full day. For example, if you had the equipment for any portion of a day beyond a whole number of days, that partial day is billed as a full day.
7. Worked Examples
The following examples illustrate how these Rental Policies apply in practice. All examples use the following base values unless otherwise noted:

Example 1: Security Deposit Calculation
The hold equals the greater of the FMV-based deposit (FMV_calc) or the rental fees calculation (RentalFees_Calc). For $1,000 replacement value equipment: FMV_calc = $500. RentalFees_Calc = rental fees + 2 days at $100/day.

FMV_calc for other replacement values:
- $500 FMV → FMV_calc = $250 (50% × $500)
- $2,000 FMV → FMV_calc = $700 ($500 + 20% × $1,000)
- $5,000 FMV → FMV_calc = $1,300 ($500 + 20% × $4,000)
- $15,000 FMV → FMV_calc = $3,300 ($500 + 20% × $14,000)
- Above $15,000 → COI required; standard hold not available
Example 2: Booking Deposit and Cancellation Interaction
The booking deposit is 10% of the total booking cost. If a booking is canceled within 24 hours of the rental start time, Mighty Mini Equipment Rental retains exactly the one-day rental rate. If the deposit exceeds the one-day rate, the difference is refunded.

If the renter rebooks within 3 months in any of the above scenarios, the retained amount is credited toward the new rental.
Example 3: Early Return — Day Rounding
Equipment is booked for 4 days at $100 per day. The renter returns early. Charges are based on actual days of possession rounded up to the nearest full day.

A renter who returns equipment after 1 hour of day 2 is charged for 2 full days. Contacting Mighty Mini Equipment Rental before the end of the rental term is required to arrange an early return.
Example 4: Damage Scenarios — Four Coverage Combinations
Using a 1-day rental at $100/day with $1,000 replacement value equipment: FMV_calc = $500. RentalFees_Calc = $100 + $200 = $300. Without COI, hold = MAX($500, $300) = $500. With COI, hold = $300.
Scenario A — No COI, No Damage Waiver
Hold: $500. After capturing $100 in rental fees, $400 remains available for damage.

For major damage, the $500 hold covers rental fees and $400 of damage. The remaining $500 is pursued as an additional charge.

Renter’s out-of-pocket cost is rental fees only. Mighty Mini files against the COI for damage.

Renter’s out-of-pocket cost is $200 in all outcomes — rental fees plus waiver fee. The waiver and COI together absorb all damage.
Example 5: Underinsurance — COI Does Not Fully Cover Damage
A renter provides a COI and does not elect the damage waiver. Damage of $900 occurs. The renter’s insurer pays only $500 due to a $400 deductible. The remaining $400 is the renter’s responsibility.

If the renter had also elected the damage waiver ($100 fee), the waiver would absorb up to $750 of the $900 damage. The remaining $150 would be covered by the COI (exceeding its deductible). The renter’s total cost would be $300 rental + $100 waiver fee = $400, with no gap.
Example 6: Damage Waiver Exclusion — Monitor-and-Notify Failure
A renter fails to notice that engine oil has dropped critically low and continues operating. The engine seizes, resulting in $1,500 in repair costs. The renter elected the damage waiver.

The damage waiver does not apply because the damage resulted from failure to monitor a key maintenance item and failure to cease operation and notify Mighty Mini Equipment Rental. Electing the waiver does not protect against excluded causes.
Example 7: Theft — No Waiver Coverage
Equipment valued at $1,000 is stolen during the rental period. The renter did not elect the damage waiver and did not provide a COI. The rental was 3 days at $100/day.

The renter must file a police report within 24 hours of discovering the theft and provide a copy to Mighty Mini Equipment Rental. Law enforcement will be notified. The remaining $500 will be pursued through collections or civil proceedings.
Example 8: Extended Rental — Re-Authorization and Partial Capture
A renter books a 14-day rental at $100/day with no COI. Replacement value is $1,000.

Because the rental exceeds 7 days, Mighty Mini Equipment Rental will re-authorize the hold before the original 7-day authorization expires. Partial captures of accrued rental fees may occur at 7-day intervals.

Renters will be informed of the re-authorization and partial capture schedule at pickup.
The examples above are illustrative. Actual amounts depend on the equipment’s replacement value, daily rental rate, rental duration, damage assessment, and other factors specific to each rental. 8. Changes to These Policies
Mighty Mini Equipment Rental may update these Rental Policies at any time. When we make material changes, we will update the “Last Updated” date at the top of this document and, where appropriate, notify you by email or through a notice on our website. The Policies in effect at the time of your booking govern your reservation. Continued use of our Services after any update constitutes your acknowledgment of the revised Policies.
